KIIS v KISS: Brand War

brett farrelMy new Lawyer pal, Brett Farrell, in Australia has just posted a fascinating blog about the brand warfare that is being waged in the Australian radio-scape.  Melbourne’s KISS was first but now ARN’s KIIS is coming round (yes, using the very famous LA KIIS brand).  Brett writes from the legal point of view but does so in such a manner that a dunce like me can understand.  Excerpt below and full article at the link.

I don’t remember the details exactly but I believe at some point there was a battle in the States between Kiss Country in Miami (WKIS) and CC.  I think they settled on letting Beasley keep the name but never expand with it.  Why do I bring this up?  I don’t know.  I was bored.  Plus I don’t have the exact right information….so forget it.  Read on.

Melbourne Kiss had been using the name since 2001 and only on 12 November 2013 had itstarted to file its trade mark registration for the “KISS FM” mark. However, a former mark expired in 1999. ARN Kiis has also filed two trade mark applications for “KiisFM1065” and “1065KiisFM” but only got those filed on 25 November 2013.
